Theft & Vandalism Policy

PURPOSE:

To prevent and detect fraud, vandalism and theft, assign responsibility for implementing appropriate controls to prevent and detect same, establish the appropriate reporting mechanisms to be used for notification of known or suspected vandalism, fraud and theft, and establish the consequences for vandalism, fraud and theft by any individual(s).

APPLIES TO:

All SSR employees, customers, vendors, contractors, consultants, or other parties related to the Silver Star Ranch.

LOCATION: Silver Star Ranch sites and Remote Offices located in Europe.

POLICY STATEMENT:

Scope of Policy

Silver Star Ranch employees/guests must comply with applicable provincial and federal law, SSR policy. Furthermore, a SSR employee cannot be compelled by a supervisor to violate a law, or policy.

As a private company, Management has a fiduciary responsibility to conserve, preserve, and efficiently use all SSR resources.

This policy applies to any known or suspected vandalism, fraud or theft involving employees, customers, vendors, contractors, consultants, or other parties related to SSR.

Prevention and Detection of Fraud and Theft

SSR employees/customers shall not perpetrate, engage in, or otherwise facilitate the act of committing vandalism, fraud and theft.

The Management of SSR are responsible for establishing the controls to prevent and detect vandalism, fraud and theft. Managers are responsible for knowing the types of improprieties that might occur within their areas of responsibility and for identifying and assessing any irregularities. SSR employees/customers are responsible for the prevention and detection of vandalism fraud and theft that might occur within the scope of their work or visits and for reporting any known or suspected vandalism, fraud and theft.

Reporting Known or Suspected Fraud and Theft

Employees/customers are responsible for immediately reporting known or suspected incidents of vandalism, fraud, including theft and misappropriation of SSR assets, to Sheriff@SilverStarRanch.net .

Any employee/customer who has knowledge of vandalism, fraud or theft of SSR assets by any person or organization, including another employee/customer, and does not report it to SSR officials may be subject to disciplinary action, up to and including termination of employment.

If the initial notification is to Sheriff@SilverStarRanch.net  , Sheriff shall notify the appropriate policing services office.

Investigation of Reports of Known or Suspected Vandalism, Fraud and Theft

The Sheriff’s office shall investigate allegations of vandalism, fraud and theft in accordance with established policies and procedures.

Sheriff shall be responsible for ascertaining the extent of loss, and for reviewing and evaluating control and/or process failures related to the loss. Sheriff will also notify the Local Police Officer and file said report.

Any employee/customer who suspects fraudulent activity should not attempt to personally conduct an investigation related to the activity. If the employee/customer elects to notify management first, then management must immediately notify Sheriff’s office. Concerns about work performance and workplace behaviour that are unrelated to fraudulent activity should be resolved by management and Human Resources: they should not be reported under the vandalism, fraud and theft policy. If there are any questions about what constitutes vandalism, fraud and theft, Sheriff’s Office should be contacted.

Reports and investigations of allegations of vandalism, fraud and theft ordinarily will be kept confidential to the reasonable extent possible under law and consistent with the need to conduct an adequate investigation and take corrective action.

CONSEQUENCES:

If appropriate officials conclude that an employee/customer has engaged in vandalism, fraud or theft, appropriate disciplinary action will be pursued, up to and including termination of employment, in accordance with applicable personnel policies for staff. In addition, employees/customers engaging in vandalism, fraud or theft will be required to pay restitution, including the cost of the investigation.

Employees of the Silver Star Ranch who engage in vandalism, fraudulent activity or theft are not acting within the scope of their employment and should not expect protection for their acts under either the Alberta Law or any applicable insurance policy.

It is the policy of Silver Star Ranch to pursue legal action based on the merits of the case in consultation with the Sheriff’s Office General Counsel.

Ordinarily, the submission of a resignation by an employee accused or suspected of vandalism, fraud or theft will not preclude later disciplinary action, including restitution and legal action. If restitution is required, payment arrangements will be established with the Sheriff’s office.
